CLIENT CONTRACT

PHOTOGRAPHY AGREEMENT between Heather Beckman Photography LLC (The Studio) and Client, for the provision of photography and related services. 

1. COMPENSATION. This contract is valid only of the amounts specified above. Failure by Client to make payments as scheduled may be deemed a material breach of this agreement. Retainer fees are non refundable and due upon booking in order to secure your date. The remaining balance is due in full the day of your session. In case of inclement weather, illness or circumstances out of The Studio's control, retainer fee will be used to secure rescheduled date of session, but will not be refunded. In the even of material breach, Heather Beckman Photography LLC at its option, may cancel this agreement and be relieved from any further obligation of performance.

2. CANCELLATION OR RESCHEDULING YOUR SESSION. In the unfortunate even that the session is cancelled with less than 48 hours notice to The Studio, you will be invoiced for the remainder of your session fee. In the case of inclement weather, illness or circumstances out of The Studio's control, and the scheduled date of session needs to be rescheduled, retainer fee will be used to secure rescheduled date of session but will not be refunded. CLIENT RESCHEDULED SESSIONS WILL NOT BE RESCHEDULED UNTIL NEXT SCHEDULING PERIOD. 

3. GALLERY AND EXPECTED DELIVERY TIME. Heather Beckman Photography LLC promises to deliver online gallery with 10 digital edited images within 1 day from the session date. Online gallery will be sent to email provided. In the case that photos are needed prior to the 1 day turn around time, a rush service fee of $50 is require and a rush date of delivery would need to be agree upon. Please note, rush services are not always available, depending on time of year, etc. and Heather Beckman Photography LLC availability. 

4. LIABILITY/WAIVER OF DAMAGES. The Studio represents that reasonable care is taken with respect to capturing, developing, processing, storing and delivery of your images. However, in the event that The Studio fails to comply with the obligations of this contract, for any reason, including but limited to events outside of The Studio's control or The Studio's own negligence, The Studio's liability shall be limited to a refund of all payments made by you. 

5.PHOTOGRAPHER RIGHTS. The photographer will be the sole exclusive owner of the Photographs (unless otherwise noted) and all rights with respect to those Photographs including all rights in and to the Photographs created by the photographer, in all media and all forms of exploitation whether now known or hereafter devised, including all allied and subsidiary rights, such as merchandising rights, noninteractive and interactive electronic publication rights, multimedia rights, publication rights including for publicity and advertising purposes. 

6. CREATIVE RIGHTS. The photograph may edit the Photographs in its discretion and will NOT offer or distribute all images shot nor will the photographer offer any RAW or unedited images to the client. RAW images will remain the exclusive property of The Photographer. The photographer reserves the right to edit and release only those Photographs deemed creditable as professional in quality and within the Photographers artistic standards. The client understands that Photography is a form of Art and art is subjective - meaning the client leaves the sole discretion of editing style, edited images, etc. up to The Photographer.
